What Environment Protection and Biodiversity Conservation Act 1999 - Referral, Assessment and Approval of Actions that May Impact Matters of National Environmental Significance requires
The EPBC Act 1999 requires any mining project proponent whose action is likely to have a significant impact on a Matter of National Environmental Significance (MNES) to refer that action to the Australian Minister for the Environment so the Minister can decide, under Section 75, whether it is a controlled action requiring assessment and approval. This applies to all coal, mineral, and extractive industries operating in or near MNES-listed areas.
