What Spain Ley 3/1991 de Competencia Desleal requires
Ley 3/1991, de 10 de enero, de Competencia Desleal (LCD) is Spain's principal Unfair Competition Act, in force from 31 January 1991 and substantially amended in 2009 to transpose the EU Unfair Commercial Practices Directive 2005/29/EC. The Law is organised into five Chapters. Capitulo I (Arts. 1-3) contains general provisions on the purpose of the law, its market-activity scope and its broad personal application. Capitulo II (Arts. 4-18) defines acts of unfair competition - including Art. 4 the cláusula general prohibiting conduct objectively contrary to good faith, Art. 5 acts of deception, Art. 6 acts of confusion, Art. 7 deceptive omissions and Art. 8 aggressive practices. Capitulo III (Arts. 19-31) regulates pra-cticas comerciales con los consumidores or usuarios applying the UCPD black-list rules. Capitulo IV (Arts. 32-36) governs the legal actions available against unfair competition, with Art. 32 enumerating declaratory, cessation, removal-of-effects, rectification, damages and unjust enrichment remedies. Capitulo V regulates codes of conduct and industry self-regulation.
