What Regulation (EU) 2022/1031 of the European Parliament and of the Council of 23 June 2022 on the access of third-country economic operators, goods and services to the Union public procurement and concession markets and procedures supporting negotiations on access of Union economic operators, goods and services to the public procurement and concession markets of third countries (International Procurement Instrument - IPI) requires

This Regulation, the International Procurement Instrument, allows the Commission to investigate alleged measures or practices of a third country that restrict access of Union economic operators, goods and services to that country procurement market, and to adopt IPI measures (Articles 1, 5 and 6). IPI measures take the form of a score adjustment of tenders or the exclusion of tenders, and apply to procurement procedures with an estimated value at or above EUR 15 000 000 net of VAT for works and concessions, and at or above EUR 5 000 000 net of VAT for goods and services (Articles 1 and 6). Successful tenderers face sub-contracting obligations limiting goods or services from the targeted country (Article 8).
