What Directive (EU) 2024/2853 of the European Parliament and of the Council of 24 October 2024 on liability for defective products, amending Regulation (EU) 2023/988 and repealing Council Directive 85/374/EEC requires
This Directive expands product liability to cover software, AI systems, and digital services, imposes a reversed burden of proof in cases involving complex technologies (Article 8), removes financial caps on damages, establishes a 10-year limitation period (Article 15), and holds non-EU economic operators liable if their products are placed on the EU market (Article 12). It applies to all producers, importers, and distributors placing digital or physical goods into the EU.
