What Regulation (EU) 2018/1860 of the European Parliament and of the Council of 28 November 2018 on the use of the Schengen Information System for the return of illegally staying third-country nationals requires
This Regulation governs the use of the Schengen Information System (SIS) for the return of illegally staying third-country nationals (Article 1). Member States must enter an alert on return into SIS following a return decision (Article 3), defining the categories of data (Article 4) and the authority responsible for the exchange of supplementary information (Article 5). It sets procedures for hits at the external borders on exit confirming return (Article 6), handling of non-compliance with return decisions (Article 7), hits on entry (Article 8), prior consultation before granting a residence permit (Article 9), and deletion of alerts once return is confirmed (Article 14).
