Section 40 of the Nationality and Borders Act 2022 amends Section 24 of the Immigration Act 1971 to create and expand offences relating to illegal entry, arrival, and remaining in the United Kingdom. It is an offence to knowingly enter the UK in breach of a deportation order or without leave when leave is required, to knowingly arrive in the UK without the required entry clearance or Electronic Travel Authorisation, or to remain beyond the period authorised by leave. Maximum penalty on indictment is five years' imprisonment; on summary conviction in England and Wales, up to 12 months and/or a fine.
