What UK Sexual Offences Act 2003 Section 5 - Rape of a Child Under 13 requires
A person commits the offence of rape of a child under 13 if he intentionally penetrates the vagina, anus or mouth of another person with his penis and the other person is under 13. The offence is strict liability as to age and consent: belief that the child was 13 or over, or that the child consented, is no defence. The offence is indictable only and carries a maximum sentence of life imprisonment. It is the gravest of the SOA 2003 child-protection offences and underpins the absolute prohibition on penile penetration of children under 13.
