What UK Stalking Protection Act 2019 Section 2 - Stalking Protection Orders requires
Section 2 of the Stalking Protection Act 2019 empowers a magistrates' court, on application by a chief officer of police, to make a Stalking Protection Order (SPO) against a person where the court is satisfied on the balance of probabilities that (a) the defendant has carried out acts associated with stalking; (b) the defendant poses a risk associated with stalking to another person; and (c) there is reasonable cause to believe the proposed order is necessary to protect another person from such a risk. The order may impose prohibitions or requirements for a specified period of at least 2 years (with no maximum) - including prohibition on contact, geographical exclusion, electronic monitoring, surrender of devices, attendance at perpetrator programmes. Breach of the order is a criminal offence under Section 8 with up to 5 years on indictment.
