US 40 CFR Part 261 identifies solid wastes that are subject to regulation as hazardous wastes under Subtitle C of the Resource Conservation and Recovery Act (RCRA). Wastes are hazardous if they exhibit a characteristic (ignitability, corrosivity, reactivity, toxicity via TCLP) or are listed in Subparts D (F-list non-specific sources, K-list specific sources) or E (P-list and U-list discarded commercial chemical products). Generators must determine if their waste is hazardous before disposal and obtain an EPA ID number if generating more than 100 kg of hazardous waste in a calendar month or any acutely hazardous waste.
