What 41 USC § 6502 - Walsh-Healey Public Contracts Act (Required Contract Stipulations) requires
41 USC § 6502 (originally enacted as the Walsh-Healey Public Contracts Act of 1936, Pub. L. 74-846; recodified by Pub. L. 111-350) requires every federal contract exceeding $10,000 for the manufacture or furnishing of materials, supplies, articles, and equipment to contain four mandatory representations and stipulations: (1) WAGES - all individuals employed by the contractor in performing the contract will be paid not less than the prevailing minimum wages, as determined by the Secretary of Labor; (2) HOURS - no individual employed by the contractor in performing the contract shall be permitted to work in excess of 40 hours in any one week (overtime under FLSA may apply); (3) CHILD AND CONVICT LABOR - no individual under 16 years of age and no incarcerated individual will be employed by the contractor (with limited exceptions for certain federal/state convict-labor programs); (4) SAFETY AND HEALTH - no part of the contract will be performed in plants, factories, buildings, or surroundings that are unsanitary, hazardous, or dangerous to the health and safety of employees; the Act is enforced by the Department of Labor Wage and Hour Division; violations expose contractors to back wage liability, contract cancellation, debarment from federal contracting for 3 years under 41 USC § 6504, and liquidated damages.
