The Defend Trade Secrets Act (DTSA) of 2016 enables private parties to bring federal civil actions for misappropriation of trade secrets related to products or services in interstate or foreign commerce, under 18 U.S.C. § 1836(b)(1). It authorizes ex parte seizure orders under § 1836(b)(2) and exemplary damages up to two times the actual damages if willful and malicious misappropriation is proven under § 1836(b)(3)(C).
