The Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement) is the WTO multilateral instrument governing measures to protect human, animal or plant life or health from food safety, animal disease and plant pest risks, and is administered by the WTO Committee on Sanitary and Phytosanitary Measures. SPS Agreement, Article 1 sets out the scope and application of the Agreement to all sanitary and phytosanitary measures which may, directly or indirectly, affect international trade. SPS Agreement, Article 2 sets out the basic rights and obligations including the right of Members to take sanitary and phytosanitary measures necessary for the protection of human, animal or plant life or health, provided that such measures are not inconsistent with the provisions of this Agreement. SPS Agreement, Article 3 governs harmonization to international standards, guidelines or recommendations developed by the Codex Alimentarius Commission, the World Organisation for Animal Health, and the Secretariat of the International Plant Protection Convention. SPS Agreement, Article 4 governs equivalence. SPS Agreement, Article 5 governs the assessment of risk and determination of the appropriate level of sanitary or phytosanitary protection. SPS Agreement, Article 7 governs transparency. SPS Agreement, Article 8 governs control, inspection and approval procedures. SPS Agreement, Article 11 governs consultations and dispute settlement. The Agreement is the controlling WTO instrument for sanitary and phytosanitary measures.
