Australian Privacy Principle 11 (APP 11) in the Privacy Act 1988 (Commonwealth) requires APP entities to take reasonable steps to protect personal information from misuse interference and loss as well as from unauthorised access modification or disclosure. APP entities include Australian Government agencies and private sector organisations with annual turnover of more than AUD 3 million. The Notifiable Data Breaches (NDB) scheme in Part IIIC requires notification of eligible data breaches to the Office of the Australian Information Commissioner (OAIC) and affected individuals as soon as practicable. The Privacy Act 2024 amendments introduced statutory tort for serious invasions of privacy and increased maximum civil penalties to AUD 50 million or 30% of adjusted turnover.
