What EU AI Act (EU) 2024/1689 - Article 25: Responsibilities Along the AI Value Chain requires
Article 25 establishes clear role transitions within the AI value chain that shift provider obligations to other economic operators. An importer or distributor becomes a provider - and assumes all Article 16 provider obligations - when they: (a) place a high-risk AI system on the market under their own name or trademark; (b) modify the intended purpose of a high-risk AI system already placed on the market; or (c) make a substantial modification to a high-risk AI system. Additionally, any provider who integrates a general-purpose AI (GPAI) model into a high-risk AI system becomes responsible for the high-risk AI system's compliance with the EU AI Act - even if the GPAI model was developed by a third party. Article 25 also addresses the case where a high-risk AI system is developed for a deployer's own internal use - the deployer becomes the provider.
