Annex III, point 7 of the EU AI Act classifies AI systems used in migration, asylum and border control management as high-risk, in so far as their use is permitted under relevant Union or national law. Covered use cases are polygraphs and similar tools, entry risk assessments, assistance in examining asylum, visa and residence permit applications, and detection or identification of natural persons. Deployment by public bodies triggers a fundamental rights impact assessment under Article 27 and registration in a secure non-public section of the EU database under Article 49(4). Emergency use before conformity assessment is possible only under the Article 46 derogation.
