EU AI Act Regulation 2024/1689 Article 33 establishes that where a notified body subcontracts specific conformity assessment activities or uses a subsidiary to perform those activities, it must ensure that the subcontractor or subsidiary meets the same requirements as the notified body itself, that the notified body remains fully responsible for the work performed by its subcontractors and subsidiaries, that the notified body must inform the notifying authority and the provider of the subcontracting arrangements, and that assessment activities directly related to the AI system's core safety functions may not be subcontracted.
