Kenya's Water Act (No. 43 of 2016) repeals and replaces the Water Act of 2002 and devolves water functions per the 2010 Constitution. The Water Resources Authority (WRA) regulates water resources and issues water permits. The Water Services Regulatory Board (WASREB) regulates water and sewerage service providers. Water Resources Users Associations (WRUAs) manage catchment conservation at community level. The Cabinet Secretary may declare water scarcity areas with additional controls. Abstraction of water from a public water resource requires a WRA permit; discharges require separate authorisation. The National Water Harvesting and Storage Authority (NWHSA) manages dams, irrigation and other water infrastructure under Cabinet Secretary oversight.
