What US 34 CFR Part 99: Family Educational Rights and Privacy (FERPA) requires
US 34 CFR Part 99 implements the Family Educational Rights and Privacy Act (FERPA) of 1974 protecting the privacy of student education records. FERPA applies to educational agencies and institutions receiving funds under any Department of Education program. Parents (or eligible students 18+) have the right to inspect and review education records, request amendment, and control disclosure to third parties (with exceptions including school officials with legitimate educational interest, schools to which student is transferring, accrediting agencies, financial aid, health and safety emergencies, and parents of dependent students under tax code). Annual notification of FERPA rights required. Penalty: withholding of Department of Education funds (no private right of action per Gonzaga v. Doe).
