What 2023 Merger Guidelines requires
The 2023 DOJ/FTC Horizontal Merger Guidelines establish a framework for identifying mergers that may substantially lessen competition or tend to create a monopoly under Section 7 of the Clayton Act (15 U.S.C. § 18).
