California Senate Bill 896, authored by Senator Dodd and enacted as Chapter 928 of the Statutes of 2024, was signed by Governor Newsom on 29 September 2024 and codifies key generative AI accountability measures for state government agencies. The Act requires state agencies and departments using generative AI to communicate directly with Californians about government services or benefits to include a disclaimer that the communication was generated by generative AI in the manner required by the medium, including prominent placement at the start of letters and emails, throughout chatbot interactions and verbally for audio interactions. The communication must also provide information or a link describing how the recipient can contact a human state employee. The Office of Emergency Services is required to perform a risk analysis of potential threats posed by generative AI to California's critical energy, water, communications, transportation and emergency services infrastructure and to report annual summaries to the Legislature. The Department of Technology is required to update the Governor's report on generative AI as significant new developments emerge. Implementation guidance is coordinated by the Government Operations Agency, the Office of Data and Innovation and the California Department of Human Resources. The Act applies to communications between state agencies and Californians about government services or benefits.
